On Monday, July 28, 2025, Robert Charles Regan, 42, of Greenwood, South Carolina, was sentenced to 20 years in prison for his role in a deadly DUI crash that occurred in December 2023. The charges included felony DUI resulting in death and failure to stop for blue lights resulting in death.
According to the 8th Circuit Solicitor’s Office, Regan was pulled over on the 72 Bypass for erratic driving. After being suspected of driving under the influence, he fled the scene in a Dodge 2500 Ram pickup truck. During the pursuit, Regan drove between stopped cars at an intersection with Laurel Avenue and crashed into the driver’s side of an SUV.
The driver of the SUV, 85-year-old David Rearden, an Army veteran of the Vietnam War, was rushed to the hospital but died on the way. Regan continued fleeing after the crash and struck a law enforcement vehicle before officers managed to stop him and remove him at gunpoint.
Toxicology reports showed Regan’s blood alcohol content was .109, above the legal limit of .08. Investigators from the South Carolina Highway Patrol found that Regan was driving 68 mph in a 35 mph zone shortly before the crash. Jail calls revealed that Regan admitted to being drunk and running from the police to avoid getting a DUI charge.
Fatal DUI crashes in South Carolina can lead to serious criminal charges for the driver and long-term consequences for the victims’ families. In cases like this, the family may have grounds to file a wrongful death claim under South Carolina law.
A wrongful death claim can help recover damages such as medical expenses, funeral costs, and the emotional loss of a loved one’s companionship and support.
Families considering legal action should be aware that the statute of limitations for filing a wrongful death lawsuit in South Carolina is typically three years from the date of death. Speaking with a qualified South Carolina attorney can help families understand their legal rights and next steps.
This case is a sobering reminder of the dangers of impaired driving and fleeing from law enforcement. To help prevent tragedies like this, consider the following:
If you plan to drink, arrange a safe way home through a designated driver or rideshare.
If you see a driver you suspect may be impaired, safely pull over and call 911.
Always comply with law enforcement during a traffic stop. Attempting to flee only increases the risk of harm to yourself and others.
